Terms of service and cancellation policy

These Terms of Service, together with the Code of Conduct (https://www.adriata.org/code-of-conduct) (collectively, the "Code of Conduct"), establish a legally binding agreement between you (the "Client") and Adriata ("Adriata").

These Terms govern your use of Adriata’s website, content, and all services provided by our partner hubs (referred to as the "Partner School" or “Hubs”). Adriata reserves the right to modify or update these Terms at any time. In these Terms, "Students" refers to the children of the Client who will be participating in the services provided by Adriata

Any changes will take effect immediately upon being posted on the Adriata platform. It is your responsibility to review the Terms periodically. Continued use of the platform after any modifications signifies your acceptance of the revised Terms.

By purchasing any of our Services, you: acknowledge that you have read, understood, and accepted these Terms, as well as our Privacy policy (https://www.adriata.org/privacy-policy); and agree that these Terms form a binding agreement governing your rights as a Client and your relationship with Adriata.

Services provided by Adriata

  • Adriata curates Partner Schools and promotes short-term enrollment opportunities.

  • Adriata manages the collection and sharing of necessary legal and administrative information with Partner Schools.

  • Adriata ensures high standards by regularly assessing and reviewing our Partner Schools.

Client’s responsibility and legal obligations

  • Conduct: Clients are expected to act with integrity, respect others, and comply with all applicable laws and regulations. Disruptive or inappropriate behavior may result in the termination of your enrolment and exclusion from Adriata services.

  • Legal compliance: By completing a booking, you confirm that you are legally permitted to travel to and stay at the Hub’s location for the entire enrolment period.

  • Travel documentation: You are solely responsible for obtaining and ensuring the validity of necessary visas, passports, or other required documents for your stay. Adriata shall not be liable for any issues arising from your failure to obtain these documents. Any costs, fines, or expenses incurred due to inadequate or missing documentation are your sole responsibility.

  • Responsibility for updates: You agree to stay informed about the entry requirements of your destination(s) and to promptly notify Adriata of any changes in travel plans or circumstances that may affect your ability to secure the necessary documents.

Booking and payment

  • Booking: By making a booking through Adriata, you agree to pay the specified tuition fees for the selected Hubs and duration.

  • Deposit: A deposit is required at the time of booking to secure your reservation.

  • Balance payment: For some Hubs, the remaining balance must be transferred to our Adriata Partner School before the first day of school. For others, you can settle the remaining balance on the first day of school.

  • Payment processing: In some cases, Adriata acts as an intermediary for processing payments. You authorize Adriata to charge the total booking amount to your designated payment method.

Cancellation policies

  • Cancellation more than two months before arrival: If you cancel your reservation more than two months before the arrival date, you will receive a full refund of the deposit.

  • Cancellation within two months to two weeks before arrival: If you cancel within two months before the scheduled arrival date, the deposit is non-refundable.

  • Cancellation less than two weeks before arrival: If you cancel less than two weeks prior to the arrival date, full payment for the booking is required. Additionally, if the original booking is modified, resulting in a shortened duration within the two-week period before arrival, you will be responsible for payment of the canceled days.

  • Early departure, no-show, or cancellation after arrival: If you arrive but choose to depart earlier than scheduled, fail to show up for your reservation, or cancel after arrival, full payment is still required.

  • Processing fee for cancellations: All client-requested cancellations are subject to a 10% processing fee (10% of the total refund amount). This fee will be deducted from the total refund, regardless of the reason for cancellation.

  • Cancellations by Partner School: If the experience is canceled by the Partner School due to unforeseen circumstances, you will be offered either a rescheduled date or a full refund, based on your preference and/or availability.

Insurance

  • While our Partner Schools carry insurance, you are solely responsible for securing any necessary travel insurance, health insurance, or other coverage required for the duration of your stay.

Damages

  • You acknowledge sole responsibility for any damages incurred to the Partner School location during your stay. Partner Schools reserve the right to invoice you for any damages or additional fees.

Liability

  • Adriata's Role: Adriata acts solely as an intermediary between Clients and Partner Schools. We do not own, operate, or control the Hubs listed on our website. Adriata is not liable for any damages, losses, or expenses arising from your use of the platform or any bookings made through it.

  • Indemnification: You agree to indemnify and hold Adriata, its affiliates, and employees harmless from any claims, damages, or liabilities arising from your use of the platform, including any violation of these Terms.

Intellectual Property

  • Ownership: All intellectual property rights related to Adriata's platform, including its website, social media, and content, are owned by Adriata and its Partner Schools. You agree not to reproduce, distribute, or modify any copyrighted material without prior written consent from Adriata.

Rebooking and non-competition

  • The unique experiences, information, and knowledge gained through participation in Adriata are proprietary and confidential. You agree not to use this information to replicate, imitate, or develop any competing product or service. This restriction applies to the concept, operational model, community engagement strategies, and all other fundamental elements of Adriata.

Data sharing with Partner Schools

  • Compliance with Data Protection Laws: The Parties agree to comply with all applicable data protection laws, including Regulation EU 2016/679 (GDPR). Both parties are considered co-controllers under GDPR.

  • Data sharing consent: By accepting these Terms, you grant Adriata permission to share specific information with our Partner Schools. This may include, but is not limited to, citizenship, learning needs, medical history, educational history, and family circumstances.

  • Use of shared information: Partner Schools may obtain, hold, use, and communicate confidential information that is deemed material to the safety and welfare of the Student and others.

  • Purpose of data sharing: The primary purpose of sharing this information is to facilitate a smooth and efficient enrollment process at the Partner School, enhancing your overall experience during your stay.

  • Disclosure of information: Clients consent to physical contact that aligns with best practices and is deemed appropriate for instructional purposes, offering comfort to a Student in distress, ensuring safety, or addressing health and welfare needs.

  • Health and welfare information: Clients are required to promptly and confidentially inform Adriata of any known medical conditions, health issues, or allergies affecting the Student. This includes disclosing any history or diagnosis of learning difficulties related to the Student or immediate family members, as well as any family circumstances that could impact the Student’s welfare, safety, or security.

Solicitation and non-compliance

  • Prohibition on solicitation: You agree not to solicit or collect information about other families or members of the Adriata community, particularly for the purposes of sending unsolicited communications, promoting commercial activities, or engaging in political lobbying.

  • Consequences of non-compliance: Adriata may, at its sole discretion, suspend or terminate your access to the platform if you violate any of these Terms or engage in any conduct that may be harmful to Adriata, its Clients, or Partner Schools.
